Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ClipTours, a service that turns real-estate listing photos and details into AI-generated tour videos (the “Service”), operated by ClipTours (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of terms

By accessing or using ClipTours, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time as described in Section 14 below.

2. Service description

ClipTours allows real estate professionals to upload listing photos and property details and generate short AI-produced tour videos suitable for marketing a property listing. The Service is provided as-is and may be updated, changed, or discontinued in whole or in part at our discretion.

3. Accounts & eligibility

You must be at least 18 years old and able to form a binding contract to use ClipTours; it is intended as a business tool for real estate professionals and brokerages, not for personal or household use. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate registration information (including your name, email, and brokerage) and to keep it up to date.

4. Credits & payments

Video generation is metered through a prepaid credit system. Credits are consumed when you request a video generation; if a generation fails, the credits used for that attempt are automatically refunded to your balance. Where paid features are enabled, purchasing additional credits or a subscription plan will be processed through a designated payment method at the price displayed at time of purchase, and all fees are non-refundable except as required by law or as otherwise stated at checkout. In the current release, credit purchases may operate in demo mode without a live payment processor; no real charge is made until a payment processor is enabled and disclosed to you.

5. Acceptable use

You agree not to misuse the Service. This includes, without limitation, agreeing not to: scrape, crawl, or bulk-extract data from the Service; reverse engineer, decompile, or attempt to derive the source code or underlying models of the Service; resell, sublicense, or provide the Service to third parties as a competing offering; circumvent rate limits or other technical restrictions; or use the Service to upload content you do not have the right to use. We may rate-limit, suspend, or terminate access for accounts that violate this section.

6. User content & license

You retain all ownership rights in the photos, listing details, and other materials you upload (“User Content”). By uploading User Content, you grant us a limited, non-exclusive, worldwide license to host, store, process, and transmit that content solely as necessary to operate and provide the Service to you, including sending it to third-party AI providers as described in Section 10. You represent that you own or have all necessary rights and permissions to upload and use the User Content you submit.

7. AI-generated content disclaimer

Videos produced by ClipTours are generated using artificial intelligence based on the photos and listing details you supply. AI-generated output may contain inaccuracies, artifacts, or unintended representations of a property. You are solely responsible for reviewing generated videos before publishing or distributing them, for the accuracy of any listing information you provide, and for confirming you hold the necessary rights to any uploaded photos.

8. Fair-housing responsibility

You are solely responsible for ensuring that your listings, descriptions, and generated videos comply with applicable fair-housing and anti-discrimination laws. ClipTours runs automated checks intended to flag potential fair-housing issues in listing content, but these checks are assistive only, do not constitute legal advice, and do not guarantee compliance. You should consult qualified legal counsel regarding your fair-housing obligations.

9. Intellectual property

The Service, including its software, design, branding, and underlying technology, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license granted to use the Service, these Terms do not grant you any rights to our intellectual property.

10. Third-party services

To provide the Service, we rely on third-party infrastructure and AI providers, including hosting, database, and video-generation providers described in our Privacy Policy. Your use of the Service is also subject to the applicable terms of those providers to the extent they process your data on our behalf.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service, in whole or in part, if we reasonably believe you have violated these Terms, misused the Service, or created risk or legal exposure for us. Upon termination, your right to use the Service ends immediately; certain provisions of these Terms survive termination, including Sections 6–13.

12. Disclaimers & limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our aggregate liability for any claim arising out of these Terms or the Service will not exceed the amount you paid us in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party right, including fair-housing laws and intellectual property rights in uploaded photos.

14. Changes to these terms

We may modify these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Texas.
